Umugabo w’imyaka 53 ari mu maboko y’Urwego rw’Igihugu rw’Ubugenzacyaha (RIB), nyuma yo gukekwaho gusambanya umwana w’imyaka 10, mu gikorwa gikekwa ko cyabereye mu Biryogo.

Uyu mugabo akekwaho gukorera iki cyaha cyabaye tariki 05 Mutarama 2024 mu Mudugudu wa Nyiranuma mu Kagari ka Biryogo mu Murenge wa Nyarugenge.

Aya makuru yemejwe n’Urwego rw’Igihugu rw’Ubugenzacyaha rucumbikiye uyu mugabo kuri Sitasiyo yarwo ya Nyarugenge, kugira ngo hakorwe dosiye ishyikirizwe Ubushinjacyaha, na bwo buzaregere Urukiko uyu mugabo.

Urwego rw’Igihugu rw’Ubugenzacyaha rwaboneyeho gusaba Abanyarwanda kwirinda ibikorwa nk’ibi byo gusambanya abana, kuko ababikora bahagurukiwe kandi ko abazabikora bose bazafatwa bagashyikirizwa ubutabera.

Ruvuga kandi ko ibi byaha byangizwa u Rwanda rw’ejo, kuko abana basambanyijwe bibagiraho ingaruka ndetse bikanagira ingaruka ku muryango mugari.

Ingingo ya 4: Gusambanya umwana

Ingingo ya 133 y’Itegeko nº 68/2018 ryo ku wa 30/08/2018 riteganya ibyaha n’ibihano muri rusange ihinduwe ku buryo bukurikira: “Umuntu wese ukorera ku mwana kimwe mu bikorwa bishingiye ku gitsina bikurikira, aba akoze icyaha:

1 º gushyira igitsina mu gitsina, mu kibuno cyangwa mu kanwa k’umwana;

2 º gushyira urugingo urwo arirwo rwose rw’umubiri w’umuntu mu gitsina, cyangwa mu kibuno cy’umwana;

3 º gukora ikindi gikorwa cyose ku mubiri w’umwana hagamijwe ishimishamubiri.

Iyo abihamijwe n’urukiko, ahanishwa igifungo kitari munsi y’imyaka makumyabiri (20) ariko kitarenze imyaka makumyabiri n’itanu (25).

Iyo umuntu mukuru asambanyije umwana uri munsi y’imyaka cumi n’ine (14), igihano kiba igifungo cya burundu kidashobora kugabanywa kubera impamvu nyoroshyacyaha.

Iyo umuntu mukuru asambanyije umwana ufite cyangwa urengeje imyaka cumi n’ine (14) bigatera umwana indwara idakira cyangwa ubumuga, igihano kiba igifungo cya burundu.

Iyo umuntu mukuru asambanyije umwana bigakurikirwa no kumugira umugabo cyangwa umugore, igihano kiba igifungo cya burundu kidashobora kugabanywa kubera impamvu nyoroshyacyaha.

Iyo umwana ufite imyaka cumi n’ine (14) ariko utarageza ku myaka cumi n’umunani (18) y’amavuko asambanyije umwana uri munsi y’imyaka cumi n’ine (14), ahanwa hakurikijwe ibiteganywa mu ngingo ya 54 y’iri tegeko.

Iyo umwana ufite nibura imyaka cumi n’ine (14) asambanyije umwana ufite nibura imyaka cumi n’ine (14) akoresheje imbaraga, iterabwoba, uburiganya cyangwa abikoze ku bw’intege nke z’uwakorewe icyaha, ahanwa hakurikijwe ibiteganywa mu ngingo ya 54 y’iri tegeko.”
